Terms of Sale
The terms on which Feytom supplies goods, including how orders are formed, how delivery is charged, and the limits of what we can be responsible for.
1. Who these terms are between
These terms govern the sale of goods by Feytom LLC ("Feytom", "we", "us") to you. They apply to every order, whether placed through this website or agreed by telephone or email following a quote.
Feytom sells to businesses. By placing an order you confirm that you are buying in the course of a business and that the person placing the order is authorised to do so.
2. How an order is made
Placing an order is an offer to buy. It is not accepted until we confirm it, and a contract is formed only when we dispatch the goods or tell you in writing that the order is accepted.
This matters when something is wrong on our side. If an item turns out to be unavailable, or a price or specification shown on the website is incorrect, we may decline the order before dispatch. If you have already paid, we refund you in full. We will not simply fulfil an order at a price that was published in error, and we will not quietly substitute a different product.
3. Prices
Prices are in US dollars. Unless stated otherwise, published prices are for the goods only: they exclude delivery and any sales tax. The full amount, including delivery and tax, is shown before you confirm payment.
The price that applies is the one shown when your order is placed. Prices on the website may change at any time before that, and a quote we have given you stands for the period stated on it.
4. Availability
Where a product page shows a quantity in stock, it shows the figure Feytom was given and the date it was given, and that date appears beside it. It is not a live inventory feed, and stock can be committed to another order between your seeing it and our picking it. If we cannot supply what you ordered we will tell you and refund you rather than keep your money against a later delivery you did not agree to.
5. Product information and specifications
Working load limits, breaking forces, lengths, diameters and weights are published as they were supplied to us by the manufacturer, as printed on the product packaging, or as given in the published tables of the standards body named beside the figure. Each product page states which of those a figure came from. We do not publish a specification we cannot attribute.
Photographs show the product as supplied to us. Manufacturers change packaging and finish from time to time.
If you need a batch test certificate, a mill certificate or confirmation of a specific standard for a particular delivery, ask before you order. We will tell you whether we can supply it.
6. Choosing the right product, and using it safely
This section is the most important one on this page. Read it before you order.
Feytom is a supplier. We sell the product you choose. We do not inspect your load, your vehicle, your anchor points or your application, and we are not in a position to tell you that a given product is right for a given job. Selecting suitable equipment for your use is your responsibility, and where the application calls for it, the responsibility of a competent person qualified to assess it.
Working load limits
The working load limit of a product must never be exceeded. The working load limit of an assembly is governed by its weakest component, which may be a hook, a binder, an anchor point or the vehicle structure rather than the chain or webbing itself. Shock loading, angled loading and wear all reduce what a product can safely take.
Not for overhead lifting
Grade 43 high-test chain and Grade 70 transport chain are not overhead lifting equipment. They are supplied for towing, binding, securing and restraining loads. Do not use them to lift or suspend a load over a person, and do not use them as a substitute for a rated lifting sling or Grade 80 or Grade 100 alloy chain.
Before every use
- Inspect the product for wear, stretch, cuts, abrasion, corrosion, cracks, deformation and damage to fittings.
- Remove anything damaged, deformed or shock-loaded from service. Do not repair, weld, heat or modify load-bearing equipment.
- Keep webbing and rope away from sharp edges, and protect them where contact cannot be avoided.
Securing loads on the road
If you are securing cargo on a commercial vehicle, meeting the federal cargo securement requirements — including how many tiedowns a load needs and what aggregate working load limit they must provide — is the responsibility of the carrier and driver. Buying equipment from us does not discharge it, and nothing on this website should be read as advice that a particular arrangement complies.
7. Delivery
Delivery within the United States is charged at a flat $20.00 per order. Orders of $100.00 or more, excluding delivery and tax, are delivered free.
Parcel delivery is limited by what a carrier will take as a single consignment. Orders over 150 lb, and items that ship on a pallet, are not sold through the website and are quoted individually. The Grade 43 chain drum is one of these.
We will give you an expected delivery time when we have one. Delivery times are estimates and are not guaranteed, and we are not liable for loss caused by a delivery arriving later than estimated. If a delivery date is critical to you, tell us before you order so we can say whether we can meet it.
Risk in the goods passes to you on delivery. Title to the goods remains with Feytom until we have received payment in full.
8. Checking your delivery
Please check your delivery when it arrives. Tell us within 7 days if goods are damaged, short-delivered or not what you ordered, and keep the packaging until the matter is settled — a carrier claim usually cannot be made without it. Our returns policy sets out what happens next.
9. Payment
Card payments are processed by Helcim. Card details are entered directly with Helcim and are never received or stored by Feytom. Goods are not dispatched until payment has cleared.
10. Returns
Goods may be returned only in the circumstances set out in our shipping and returns policy, which forms part of these terms. Feytom does not accept returns because you have changed your mind. Please read that policy before you order.
11. Warranty
We warrant that on delivery the goods will match their description and be free from defects in materials and workmanship. If they are not, our returns policy sets out what we will do.
Except as stated in this clause, and to the fullest extent permitted by law, Feytom makes no other warranty of any kind, express or implied, and specifically disclaims the implied warranties of merchantability and of fitness for a particular purpose. No statement on this website is a warranty that any product is suitable for your application.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
12. What we are responsible for
Subject to the paragraph above, Feytom is not liable for loss of profit, loss of business, loss of contracts, loss of use, downtime, or any indirect or consequential loss, however caused.
13. Events outside our control
We are not liable for failing to perform, or for delay in performing, where the cause is outside our reasonable control — including supplier failure, carrier failure, industrial action, severe weather, and acts of government. We will tell you and, where the delay is substantial, you may cancel the undelivered part of your order and be refunded for it.
14. Changes to these terms
The terms that apply to your order are the ones published when you placed it. We may change these terms for future orders; the version and effective date are shown at the top of this page.
15. Governing law
These terms, and any dispute arising out of them or out of any order, are governed by the laws of the State of Maryland, and the courts of that state have exclusive jurisdiction.
16. General
If any part of these terms is found to be unenforceable, the rest continues to apply. A delay by us in enforcing a term is not a waiver of it. These terms, together with our returns policy and the order we accept, are the whole agreement between us and replace anything said beforehand.
